KULLANICI SÖZLEŞMESİ / USER AGREEMENT

1. Tanımlar/Taraflar

Site/Store4Gamer: STORE4GAMERS OYUN MARKET VE TİCARET LİMİTED ŞİRKETİ Store4Gamer.com isimli alan adından ve bu alan adına bağlı alt alan adlarından oluşan web sitesi.

Mal: Store4Gamer üzerinden ve/veya Store4Gamer aracılığıyla satın alınabilecek durumda olan, fiziksel (somut) niteliği bulunan nesneler. Bazı örnekler şunlardır; bilgisayar, klavye, fare vb.

Hizmet: Store4Gamer üzerinden satın alınabilecek ve/veya Store4Gamer aracılığıyla faydalanılabilecek durumda olan dijital (sanal) ürünler ve/veya herhangi bir fayda sağlayan faaliyetler bütünü. Store4Gamer'ın sunduğu örnek hizmetler; ürün listeleme hizmeti, aracılık hizmeti, temsilcilik hizmeti, distribütörlük vb. Store4Gamer'ta satışa sunulabilecek örnek hizmetler; oyun hesapları, oyun e-pinleri, oyun kodları, yayıncı destek ödemeleri vb.

Ürün: Mal ve/veya Hizmet

Kullanıcı/Üye: Store4Gamer'a üye olan ve Store4Gamer'ta sunulan Hizmet'lerden, Store4Gamer üzerinde bulunan sözleşmelerde belirtilen koşullar dahilinde yararlanan gerçek veya tüzel kişi.

Satıcı: Store4Gamer'ta sunulan Hizmet'leri kullanmak suretiyle, hukuken mülkiyetinin haiz bulunduğu ve mülkiyet üzerinde tasarrufta bulunabilme hak ve yetkisine sahip olduğu Ürün'leri, diğer Kullanıcı'lara yönelik olarak satışa arz eden Kullanıcı.

Alıcı: Store4Gamer'ta sunulan Hizmet'leri kullanmak suretiyle, Store4Gamer veya Satıcı tarafından satışa arz edilen Ürün'leri satın alan Kullanıcı.

2. Sözleşmenin Konusu ve Kapsamı

İşbu Sözleşme'nin konusu Üye'nin Store4Gamer'tan faydalanma şartlarının, hak ve yükümlülüklerinin belirlenmesidir.

3. Tarafların Hak ve Yükümlülükleri

3.1. Üye, Store4Gamer'a üye olurken verdiği kişisel ve diğer bilgilerin kanunlar önünde doğru olduğunu, Store4Gamer'ın bu bilgilerin gerçeğe aykırılığı nedeniyle uğrayacağı tüm zararları aynen ve derhal tazmin edeceğini kabul, beyan ve taahhüt eder.

3.2. Üye, kendi Store4Gamer üyeliğine ait olan şifreyi başka kişi ve/veya kuruluşlara veremez, Üye'nin söz konusu şifreyi kullanma hakkı bizzat kendisine aittir. Bu sebeple doğabilecek tüm sorumluluk ile üçüncü kişiler veya yetkili merciler tarafından Store4Gamer'a karşı ileri sürülebilecek tüm iddia ve taleplere karşı, Store4Gamer'ın söz konusu izinsiz kullanımdan kaynaklanan her türlü tazminat ve diğer talep hakkı saklıdır.

3.3. Üye, Store4Gamer'ı kullanırken yasal mevzuat hükümlerine riayet etmeyi ve bunları ihlal etmemeyi baştan kabul, beyan ve taahhüt eder. Aksi takdirde, doğacak tüm hukuki ve cezai yükümlülükler tamamen ve münhasıran üyeyi bağlayacaktır.

3.4. Üye, Store4Gamer'ı hiçbir şekilde kamu düzenini bozucu, genel ahlaka aykırı, başkalarını rahatsız ve taciz edici şekilde, yasalara aykırı bir amaç için, başkalarının fikri ve telif haklarına tecavüz edecek şekilde kullanamaz. Ayrıca, üye başkalarının Hizmet'leri kullanmasını önleyici veya zorlaştırıcı faaliyet (spam, virüs, truva atı, vb.) ve işlemlerde bulunamaz.

3.5. Store4Gamer'ta üyeler tarafından beyan edilen, yazılan, kullanılan fikir ve düşünceler, tamamen üyelerin kendi kişisel görüşleridir ve görüş sahibini bağlar. Bu görüş ve düşüncelerin Store4Gamer ile hiçbir ilgi ve bağlantısı yoktur. Üye'nin beyan edeceği fikir ve görüşler nedeniyle üçüncü kişilerin uğrayabileceği zararlardan ve üçüncü kişilerin beyan edeceği fikir ve görüşler nedeniyle Üye'nin uğrayabileceği zararlardan dolayı Store4Gamer'ın herhangi bir sorumluluğu bulunmamaktadır.

3.6. Store4Gamer, üye verilerinin yetkisiz kişilerce okunmasından ve üye yazılım ve verilerine gelebilecek zararlardan dolayı sorumlu olmayacaktır. Üye, Store4Gamer'ı kullanmasından dolayı uğrayabileceği herhangi bir zarar yüzünden Store4Gamer'tan tazminat talep etmemeyi peşinen kabul etmiştir.

3.7. Üye, diğer internet kullanıcılarının yazılımlarına ve verilerine izinsiz olarak ulaşmamayı veya bunları kullanmamayı kabul etmiştir. Aksi takdirde, bundan doğacak hukuki ve cezai sorumluluklar tamamen üyeye aittir.

3.8. İşbu Kullanıcı Sözleşmesi içerisinde sayılan maddelerden bir ve/veya birkaçını ihlal eden Üye, işbu ihlal nedeniyle cezai ve hukuki olarak şahsen sorumlu olup, Store4Gamer'ı bu ihlallerin hukuki ve cezai sonuçlarından ari tutacaktır. Ayrıca; işbu ihlal nedeniyle, olayın hukuk alanına intikal ettirilmesi halinde, Store4Gamer'ın üyeye karşı işbu Kullanıcı Sözleşmesi'ne uyulmamasından dolayı tazminat talebinde bulunma hakkı saklıdır.

3.9. Store4Gamer'ın her zaman tek taraflı olarak gerektiğinde Üye'nin üyeliğini kısıtlama, kapatma (yasaklama) veya silme; müşteriye ait dosya, belge ve bilgileri imha etme hakkı vardır. Üye işbu tasarrufu önceden kabul eder. Bu durumda, Store4Gamer'ın hiçbir sorumluluğu yoktur.

3.10. Store4Gamer'a kayıtlı herhangi bir Kullanıcı veya bu Kullanıcı ile bağlantılı olan diğer Kullanıcılar'dan herhangi birinin işbu Kullanıcı Sözleşmesi'ni veya Satış Sözleşmesi'ni ihlal etmesi halinde bütün bağlantılı olan Kullanıcı hesapları kullanıma kapatılacaktır. Kapatılan hesaplarda Store4Gamer bakiyesi bulunması halinde ilgili Kullanıcılar'ın yapmış olduğu eylemler sonucunda oluşan bir mağduriyet bulunmuyor ise Kullanıcı ile iletişime geçilerek kendisine ait bir banka hesabına ve/veya yükleme yöntemi üzerinden iade yapılacaktır. Aksi durumda herhangi bir ön ihbara gerek kalmaksızın ilgili bakiye tutarı mağduriyetin karşılanması için kullanılacaktır.

3.11. Store4Gamer çeşitli ödeme kanalları aracılığıyla yükleme yapılan bakiyenin güvenlik kontrolünü yapmak amacıyla herhangi bir bakiye tutarını bloke edebilir. Güvenlik kontrolünden geçemeyen ve/veya bilgi paylaşmayan Üye'lerin bakiyeleri, mümkün ise yükleme yapılan ödeme yöntemi aracılığıyla iade edilir. Bu durumun oluşması halinde bakiyenin iade süreci hakkında Üye, Store4Gamer'ın güvenlik prosedürlerine ve ödeme kuruluşunun iade sürecine riayet etmek ile yükümlüdür.

3.12. Store4Gamer Satış Sözleşmesi'nde bulunan şartlar sebebiyle herhangi bir Kullanıcı'nın ve/veya bu Kullanıcı ile bağlantısı bulunan üyelerin Store4Gamer bakiyelerini bloke edebilir. Bloke edilen bakiye tutarı, satış sonrası oluşan mağduriyetin giderilmesi amacıyla ilgili işlemin Alıcı'sına iade edilmek üzere silinebilir.

3.13. Store4Gamer'ın yazılım ve tasarımı Store4Gamer mülkiyetindedir. Bunlara ilişkin telif hakkı ve/veya diğer fikri mülkiyet hakları ilgili kanunlarca korunmakta olup, bunlar Üye tarafından izinsiz kullanılamaz, iktisap edilemez ve değiştirilemez. Store4Gamer'ta adı geçen başkaca şirketler ve ürünleri, sahiplerinin ticari markalarıdır ve ayrıca fikri mülkiyet hakları kapsamında korunmaktadır.

3.14. Herhangi bir soruşturma sürecinde Store4Gamer'ın talep ettiği bilgileri, Üye'nin sahte ve/veya yanıltıcı beyanlar ile iletmesi ve/veya sahte ve/veya yanıltıcı belge sunması halinde Store4Gamer üyeliği herhangi bir ek bildirime gerek duyulmaksızın kapatılacaktır.

3.15. Store4Gamer'ın virüs ve benzeri amaçlı yazılımlardan arındırılmış olması için mevcut imkanlar dahilinde tedbir alınmıştır. Bunun yanında nihai güvenliğin sağlanması için Kullanıcı'nın, kendi virüs koruma sistemini tedarik etmesi ve gerekli korunmayı sağlaması gerekmektedir. Bu bağlamda Üye Store4Gamer'a girmesiyle, kendi yazılım ve işletim sistemlerinde oluşabilecek tüm hata ve bunların doğrudan ve/veya dolaylı sonuçlarından kendisinin sorumlu olduğunu kabul etmiş sayılır.

3.16. Store4Gamer, Site'nin içeriğini dilediği zaman değiştirme, Kullanıcı'lara sağlanan herhangi bir Hizmet'i değiştirme ve/veya sona erdirme veya Store4Gamer'ta kayıtlı Kullanıcı bilgi ve verilerini silme hakkını saklı tutar.

3.17. Üye'ler tek bir Store4Gamer hesabına sahip olabilir ve her Store4Gamer hesabı yalnızca hesap sahibi tarafından kullanılabilir. Üye'ye ait bir ya da birden fazla hesabın Üye'den farklı kişiler ile paylaşımının tespiti halinde Kullanıcı'ya bu durum bildirilecek olup, seçmiş olduğu hesap dışında bulunan bütün Site hesapları kullanıma kapatılacaktır.

3.18. Üye'ler Store4Gamer hesaplarını kullanırken, Üye'lik fonksiyonlarını/aktivitelerini gerçekleştirirken herhangi bir otomasyon/scripting/macro/recorder vb. program/yazılım kullanamazlar. Tespit edilmesi halinde, ilgili Üye hesaplarının bazı Üye'lik fonksiyonları Site'nin yapacağı değerlendirme sonrasına belirlenecek sürelerle askıya alınacaktır.

3.19. Store4Gamer, işbu Kullanıcı Sözleşmesi'nin koşullarını hiçbir şekil ve surette ön ihbara ve/veya ihtara gerek kalmaksızın her zaman değiştirebilir, güncelleyebilir veya iptal edebilir. Değiştirilen, güncellenen ve/veya yürürlükten kaldırılan her hüküm, yayın tarihinde tüm üyeler bakımından hüküm ifade edecektir.

3.20. Taraflar, Store4Gamer'a ait tüm bilgisayar kayıtlarının tek ve gerçek münhasır delil olarak, HUMK madde 287'ye uygun şekilde esas alınacağını ve söz konusu kayıtların bir delil sözleşmesi teşkil ettiği hususunu kabul ve beyan eder.

3.21. Üye, Store4Gamer'a kaydolurken girdiği iletişim bilgilerine Store4Gamer tarafından, reklam, promosyon, vb. ticari elektronik ileti gönderilmesini, doğrudan ve/veya dolaylı olarak pazarlama yapılmasını, bilgilerinin bu amaçla kullanılmasını, saklanmasını mevzuat kapsamındaki hakları saklı kalmak kaydı ile kabul eder.

3.22. Üye, Store4Gamer'ı kullanırken, Site'de meydana gelen manuel ve/veya yazılımsal herhangi bir hata/sorun sebebiyle haksız kazanç/kazanım elde ederse ve/veya sebepsiz zenginleşirse bunu Site'ye bildirmelidir. Kasıt olsun veya olmasın, işbu durumun tespiti halinde Site'nin uğrayacağı maddi zarar Üye tarafından tazmin edilmek zorundadır. Bakınız: İhtilafların Halli (Madde 5).

3.23. Store4Gamer'a giriş yapan veya üye olan tüm Kullanıcı'lar detayları açıkça belirtilmiş olan Gizlilik ve Çerez Politikası'nı okumuş, anlamış ve kabul etmiş sayılır.

3.24. Store4Gamer'a giriş yapan veya üye olan tüm Kullanıcı'lar detayları açıkça belirtilmiş olan Satış Sözleşmesi'ni okumuş, anlamış ve kabul etmiş sayılır.

3.25. Store4Gamer'a giriş yapan veya üye olan tüm Kullanıcı'lar detayları açıkça belirtilmiş olan KVKK Aydınlatma Metni'ni okumuş, anlamış ve kabul etmiş sayılır.

4. Sözleşmenin Feshi

İşbu sözleşme Kullanıcı'nın site üyeliğini iptal etmesi (veya deaktif hale getirmesi) veya Store4Gamer tarafından üyeliğinin iptal edilmesine kadar yürürlükte kalacaktır. Store4Gamer Üye'nin işbu Kullanıcı Sözleşmesi'nin herhangi bir hükmünü ihlal etmesi durumunda Kullanıcı'nın site üyeliğini iptal ederek sözleşmeyi tek taraflı olarak feshedebilecektir.

5. İhtilafların Halli

İşbu sözleşmeye ilişkin ihtilaflarda İstanbul Mahkemeleri ve İcra Daireleri yetkilidir.

6. Yürürlük

Kullanıcı'nın üyelik kaydı yapması işbu Kullanıcı Sözleşmesi'nde yer alan tüm maddeleri okuduğu, anladığı ve kabul ettiği kabul edilir. İşbu Kullanıcı Sözleşmesi, Kullanıcı'nın üye olması anında akdedilmiş ve karşılıklı olarak yürürlüğe girmiştir.

1. Definitions/Parties

Site/Store4Gamer: A website consisting of the domain name STORE4GAMERS OYUN MARKET VE TİCARET LİMİTED ŞİRKETİ Store4Gamer.com and subdomains associated with this domain.

Goods: Objects of a physical (tangible) nature that are available for purchase on and/or through Store4Gamer. Some examples are; computer, keyboard, mouse, etc.

Service: Digital (virtual) products and/or activities that provide any benefit that can be purchased through and/or available through Store4Gamer. Store4Gamer's exemplary services; product listing service, intermediary service, representative service, distributorship, etc. Sample services available for sale at Store4Gamer; game accounts, game e-pins, game codes, publisher support payments, etc.

Product: Goods and/or Services

User/Member: A natural or legal person who is a member of Store4Gamer and who makes use of the Services offered at Store4Gamer under the terms set forth in the agreements on Store4Gamer.

Seller: A User who, by using the Services offered at Store4Gamer, offers Products for sale to other Users in which he is legally in possession and has the right and authority to dispose of the property.

Buyer: The User who purchases Products offered for sale by Store4Gamer or Seller through the Services offered at Store4Gamer.

2. Subject and Scope of the Agreement

The subject matter of this Agreement is to determine the Member's conditions, rights and obligations to benefit from Store4Gamer.

3. Rights and Obligations of the Parties

3.1. Member accepts, represents and warrants that the personal and other information provided by Store4Gamer while becoming a member is correct before the law and that Store4Gamer will compensate all damages incurred due to the untruthfulness of this information in full and immediately.

3.2. The Member may not give the password of his/her Store4Gamer membership to other persons and/or organizations, and the Member has the right to use such password himself/herself. Store4Gamer reserves the right to indemnify and hold harmless from and against any and all claims and demands that may arise from such unauthorized use against Store4Gamer and against any and all claims and demands that may arise as a result of such unauthorized use.

3.3. The Member accepts, declares and undertakes in advance to comply with the provisions of the legal regulations and not to violate them when using Store4Gamer. Otherwise, all legal and criminal liabilities that may arise shall be fully and exclusively binding on the member.

3.4. The Member may not use Store4Gamer in any way that is disruptive to public order, contrary to general morality, disturbing and harassing others, for an unlawful purpose, in a way that infringes on the intellectual property and copyrights of others. In addition, the member may not engage in activities (spam, viruses, trojan horses, etc.) or actions that prevent or make it difficult for others to use the Services.

3.5. The opinions and opinions expressed, written, and used by members on Store4Gamer are solely the members' own personal opinions and are binding on the owner. These opinions and opinions have nothing to do with Store4Gamer. Store4Gamer has no responsibility for the damages that may be incurred by third parties due to the opinions and opinions to be expressed by the Member and for the damages that the Member may suffer due to the ideas and opinions to be expressed by third parties.

3.6. Store4Gamer shall not be liable for unauthorized reading of member data and for damage to member software and data. Member agrees in advance not to seek damages from Store4Gamer for any damage incurred by him or her use of Store4Gamer.

3.7. The Member agrees not to access or use the software and data of other internet users without permission. Otherwise, the legal and criminal responsibilities arising from this shall belong entirely to the member.

3.8. A Member who violates one and/or more of the terms listed in this User Agreement shall be personally and criminally liable for such violation and shall hold Store4Gamer free from the civil and criminal consequences of such violations. In addition; Store4Gamer reserves the right to claim damages against the member for non-compliance with this User Agreement if the incident is referred to the legal domain due to this violation.

3.9. Store4Gamer has the right, at any time, unilaterally restricting, closing (prohibiting) or deleting a Member's membership and destroying Customer's files, documents and information, if necessary. The Member agrees in advance to this disposition. In this case, Store4Gamer has no responsibility.

3.10. In the event that any User registered with Store4Gamer or any of the other Users associated with such User violates this User Agreement or Sales Agreement, all linked User accounts will be discontinued. If there is a Store4Gamer balance in the closed accounts, if there is no victimization as a result of the actions of the relevant Users, the User will be contacted and refunded to a bank account belonging to him / or via the upload method. Otherwise, the relevant balance amount will be used to cover the victimization without any prior notice.

3.11. Store4Gamer may block any balance amount for the purpose of performing a security check of the uploaded balance through various payment channels. The balances of the Members who fail to pass the security check and/or do not share information will be refunded via the payment method loaded, if possible. In the event of this, the Member is obligated to comply with Store4Gamer's security procedures and the payment institution's refund process regarding the refund process.

3.12. Store4Gamer may block Store4Gamer balances of any User and/or members associated with such User due to the terms contained in the Contract of Sale. The blocked balance amount may be deleted to be returned to the Buyer of the relevant transaction in order to eliminate the grievance that occurred after the sale.

3.13. Store4Gamer's software and design are the property of Store4Gamer. The copyright and/or other intellectual property rights related to them are protected by the relevant laws and may not be used, acquired or modified by the Member without permission. Other companies and their products mentioned on Store4Gamer are trademarks of their respective owners and are also protected by intellectual property rights.

3.14. Store4Gamer membership will be terminated without additional notice if the Member transmits information requested by Store4Gamer under false and/or misleading statements and/or provides false and/or misleading documentation during any investigation process.

3.15. Reasonable steps have been taken to ensure that Store4Gamer is free of viruses and similar software. In addition, in order to ensure ultimate security, the User must supply its own virus protection system and provide the necessary protection. In this context, by entering Store4Gamer, the Member agrees to be responsible for all errors that may occur in his/her software and operating systems and for their direct and/or indirect consequences.

3.16. Store4Gamer reserves the right to change the content of the Site, modify and/or terminate any Services provided to Users at any time, or delete User information and data stored with Store4Gamer.

3.17. Members may have only one Store4Gamer account, and each Store4Gamer account may only be used by the account holder. In the event that it is determined that one or more accounts belonging to the Member are shared with people other than the Member, the User will be notified of this situation and all Site accounts other than the account selected will be closed for use.

3.18. Members may not use any automation/scripting/macro/recorder etc. programs/software when using their Store4Gamer account, performing their Membership functions/activities. If detected, some of the Membership functions of the relevant Member accounts will be suspended for periods to be determined after the evaluation to be made by the Site.

3.19. Store4Gamer may change, update, or cancel the terms of this User Agreement in any form or form without prior notice and/or warning. Any provision that is changed, updated and/or repealed shall be effective for all members on the date of publication.

3.20. The parties acknowledge and agree that all computer records of Store4Gamer shall be used as the sole and true exclusive evidence in accordance with Article 287 of the HUMK and that such records constitute an evidentiary agreement.

3.21. The Member agrees to be sent by Store4Gamer commercial electronic messages such as advertising, promotions, etc., to the contact information entered when registering with Store4Gamer, to make marketing directly and / or indirectly, to use and store the information for this purpose, without prejudice to the rights under the legislation.

3.22. When using Store4Gamer, the Member must notify the Site if he/she obtains unfair gain/gain and/or becomes rich without cause due to any manual and/or software error/problem occurring on the Site. Whether intentional or not, the financial damage that the Site will suffer in case of detection of this situation must be compensated by the Member. See: Dispute Resolution (Article 5).

3.23. All Users who log in to or become members of Store4Gamer are deemed to have read, understood and accepted the Privacy and Cookie Policy, the details of which are clearly stated .

3.24. All Users who log in to or become members of Store4Gamer are deemed to have read, understood and accepted the Sale Agreement, the details of which are clearly stated.

3.25. All Users who log in to Store4Gamer or become a member are deemed to have read, understood and accepted the KVKK Clarification Text, the details of which are clearly stated.

4. Termination of Agreement

This agreement will remain in force until the User cancels (or deactivates) his/her membership to the site or until the membership is canceled by Store4Gamer. Store4Gamer may unilaterally terminate the User's site membership by canceling the User's site membership in case the Member violates any provision of this User Agreement.

5. Dispute Resolution

Istanbul Courts and Enforcement Offices are authorized in disputes related to this agreement.

6. Enforcement

The User's registration as a member is deemed to have read, understood and accepted all the articles in this User Agreement. This User Agreement was concluded at the time of the User's membership and entered into force mutually.
