SATIŞ SÖZLEŞMESİ / SALES AGREEMENT

1. Tanımlar/Taraflar

Tanımlar: Aksi belirtilmedikçe, bu sayfada kullanılan terimler Kullanıcı Sözleşmesi'ndeki terimlerle aynıdır.

2. Sözleşmenin Konusu ve Kapsamı

2.1. İşbu Satış Sözleşmesi'nin konusu, Site'de sunulan Hizmet'lerin, bu Hizmet'lerden yararlanma şartlarının ve tarafların hak ve yükümlülüklerinin tespitidir.

2.2. İşbu Satış Sözleşmesi'nin kapsamı, Site içerisinde yer alan, kullanıma, üyeliğe ve Hizmet'lere ilişkin olarak Store4Gamer tarafından yapılmış olan bilcümle uyarı, yazı ve açıklama gibi beyanlardır.

2.3. İşbu Satış Sözleşmesi'nin hükümlerini kabul etmekle, Site içinde yer alan, kullanıma, üyeliğe ve Hizmet'lere ilişkin olarak Store4Gamer tarafından açıklanan her türlü beyanı ve bu beyanlara uygun davranacağınızı da kabul etmiş olmaktasınız.

3. Alıcı Hak ve Yükümlülükleri

3.1. Alıcı, satın almak amacıyla ödeme yaptığı bir ürünü ya da ürünleri yalnızca Site'nin sunmuş olduğu iptal koşulları dahilinde iptal edebilir ya da üründen vazgeçebilir.

3.2. Alıcı, satın aldığı veya satın almaya hak kazandığı Ürün'lerin bedellerini, Güvenli Alışveriş Hizmet'ini (MADDE 6) kullanarak, Store4Gamer tarafından yönetilen Güvenli Hesap'a, Alıcı ve Satıcı arasındaki alım-satım işlemi, Ürün'ün Satıcı tarafından teslimi ve Alıcı tarafından kabulü tamamlanana kadar bloke edilmek üzere ödemenin yapılmasını temin edecektir.

3.3. Alıcı, ürünü teslim alması halinde 24 saat içerisinde işlemi tamamlamak üzere onay vereceğini kabul, beyan ve taahhüt eder.

3.4. Alıcı, Site üzerinde gerçekleşmekte olan alım-satım sürecinin herhangi bir aşamasında ve her ne sebeple olursa olsun, Satıcı'nın Ürün'ü satmaktan ve teslim etmekten vazgeçmesi halinde, bu durumdan ötürü Store4Gamer'ın hiçbir sorumluluğu ve yükümlülüğü olmayacağını; Store4Gamer'tan, satın almaya çalıştığı Ürün'ün veya muadilinin, her ne suretle olursa olsun tedarikini veya buradan hareketle herhangi bir tazminat ödenmesini talep edemeyeceğini kabul, beyan ve taahhüt eder.

3.5. Alıcı, herhangi bir Ürün satışı sonrasında oluşabilecek herhangi bir sorundan ötürü Site'nin sorumlu tutulamayacağını, oluşacak bütün sorunlarda yalnızca Satıcı'nın sorumlu tutulabileceğini kabul, beyan ve taahhüt eder.

4. Satıcı Hak ve Yükümlülükleri

4.1 Satıcı, Site'de satışa arz ettiği Ürün'ün mülkiyetinin kendisine ait olduğunu ve/veya mülkiyeti devretmeye yetkili olduğunu ve Ürün'ün kendisi tarafından satılmasına karşı herhangi bir hukuki veya diğer engel bulunmadığını, ürünlerin kişilik, telif ve diğer fikri mülkiyet haklarını ihlal etmediğini kabul, beyan ve taahhüt eder.

4.2. Satıcı, Site'de satışa arz ettiği Ürün'lerin tüm hukuki sorumluluğunun kendisine ait olduğunu, Store4Gamer'ın Ürün arzı ve satışı konusunda, hiçbir sıfat altında, kendisiyle doğrudan ve/veya dolaylı ilişki içinde olmadığını kabul eder.

4.3. Satıcı, Site'de satışa arz ettiği Ürün'ün barındırdığı içeriklerin doğruluğundan sorumludur. Ayrıca Ürün'ün Alıcı'ya transferi için gerekli olan ve/veya olabilecek kayıtlı 3. parti bağlantılar, telefon ve eposta adresine erişimi olduğunu kabul, beyan ve taahhüt eder.

4.4. Satıcı, satışa arz ettiği Ürün'ün, herhangi bir kısıtlama, yasaklama, kusur ya da belirtilmeyen herhangi bir değer düşürücü niteliğe sahip olmadığını kabul, beyan ve taahhüt eder.

4.5. Satıcı, satış sonrasında, satmış olduğu üründe yaşanacak geri alınma sebebiyle oluşan güvenlik gerekçeli kilitlenme (kısıtlama) ve/veya satış öncesinde yapılan ve/veya meydana gelen bir eylemden kaynaklı oluşabilecek kısıtlama, yasaklama hallerinde bütün sorumluluğun kendisinde olduğunu kabul, beyan ve taahhüt eder.

4.6. Satıcı, satış sonrasında, satmış olduğu ürünü ilgili oyun firması ile iletişime geçerek, ilgili hesabı (Ürünü) çalınması/erişimin kaybolması vb. gerekçelerle hesabı kurtarmayacağını, bu durumun kendi ya da bir başkası tarafından gerçekleştirilmesi halinde Site'nin ve Alıcı'nın uğrayacağı maddi ve manevi bütün zararı karşılamayı ve/veya nitelikli dolandırıcılık suçuyla hakkında soruşturma açılabileceğini kabul, beyan ve taahhüt eder.

4.7. Satıcı, satış sonrasında, satmış olduğu ürün ile alakalı olarak Store4Gamer tarafından haksız ve/veya suçlu bulunması halinde, ilgili suçu kabul etmemesi durumunda ve/veya karşılıklı anlaşmanın Store4Gamer tarafından belirlenen süre içerisinde sağlanamaması durumunda, sorunun çözümü için işbu Satış Sözleşmesi'nde bahsi geçecek olan İhtilafların Halli maddesi'ne göre işlem yapılacağını kabul, beyan ve taahhüt eder.

4.8. Satıcı, yukarıda bahsi geçen Alıcı ve/veya Store4Gamer aleyhine meydana gelen herhangi bir eylemde, Store4Gamer üyeliğinin askıya alınacağını ve/veya kapatılacağını; eğer bir sipariş söz konusu ise, siparişin bilgi ve/veya beyanda bulunmadan Satıcı aleyhinde iptal edilebileceğini kabul, beyan ve taahhüt eder.

4.9. Satıcı, Site'de satışa arz edeceği bir Ürün'ü, önceden açıkladığı sabit bir fiyatla (bedelle) satışa sunma ve satma hak ve yetkisine sahiptir. Satıcı, Alıcı'nın Ürün bedelini Güvenli Hesap'a göndermesi halinde, Alıcı'nın Ürün'ü öncelikli olarak almaya hak kazandığını kabul, beyan ve taahhüt eder.

4.10. Satıcı, Alıcı'nın Ürün'ü teslim alıp, Güvenli Hesap'taki Ürün bedelinin Satıcı'nın hesabına iletilmesi için Store4Gamer'a işlem talebinde bulunabileceğini veya Satıcı tarafından kendisine gönderilen Ürün'ün ilanda belirtilen özellik, içerik dışına çıkması ya da herhangi bir yasaklama, kısıtlama bulunması sebebiyle, Ürün'ü Satıcı'ya iade edebileceğini ve Ürün bedelinin kendisine iade edilmesi için Store4Gamer'a işlem talebinde bulunabileceğini kabul, beyan ve taahhüt eder.

4.11. Sipariş'in Alıcı'ya teslimi esnasında yukarıda açıkça bahsedilmiş olan, satıcının kabul, beyan ve taahhüt ettiği şartların sağlanmaması halinde ilgili sipariş ek bir bildirime gerek duyulmaksızın Satıcı aleyhine iptal edilecektir. İşbu durumun gerçekleşmesi halinde, hesabın güvenliği için şifrenin değiştirilmesi ve hesap güvenliğinin sağlanması Satıcı'nın sorumluluğundadır.

4.12. Satıcı, satış yaptığı hesap (Ürün) ile ilgili hiçbir bağlantısının kalmadığını ve bütün haklarını Alıcı'ya ilettiğini, aktardığını, devrettiğini kabul, beyan ve taahhüt eder.

4.13. Satıcı, satışın tamamlanması ve satışa söz konusu hesabın Alıcı'ya devrinin gerçekleşmesinden sonra, oluşacak tüm sorunlarda*, Store4Gamer yönetiminin talep ettiği, hesap ile ilgili bütün bilgileri sunacağını ve bu bilgileri iletmemesi ve/veya iletmiş olduğu bilgilerin yaşanan sorunun çözümünde yetersiz kalması durumunda, Store4Gamer'ın uğramış olduğu maddi ve manevi zararı karşılayacağını kabul, beyan ve taahhüt eder.

4.14. Satıcı, satış sonrasında, satışa söz konusu hesabın ilgili oyun firması ile iletişime geçilerek, çalınma ve/veya erişim kaybı gibi konular ile geri alınması (kurtarılması) hallerinden tam sorumlu** olacağını kabul, beyan ve taahhüt eder.

4.15. Satıcı, satmak üzere ilan eklediği Ürün veya Hizmet'in dijital olarak otomatik teslimata uygun olması ve bir Alıcı tarafından ödeme yapılarak, bedeli Satıcı'ya aktarılmak koşuluyla Alıcı'ya Ürün veya Hizmet'in anında teslim edilmesi durumunda oluşabilecek ihtilaflarda herhangi bir hak iddia edemez. Satıcı'lar, satışından vazgeçtikleri Ürün veya Hizmet'leri, vazgeçtikleri anda Site'ye giriş yaparak yayından kaldırmayı kabul, beyan ve taahhüt eder. Aksi halde satışa açık rıza gösterdiği kabul edilir.

4.16. Site, Satıcı'ya, satmak üzere ilan eklediği Ürün veya Hizmet hakkında detaylı bilgiler sorabilir. Bu sorular; Ürün/Hizmet'in nasıl temin edildiği, kullanım haklarının doğrulanması vb. şekilde olabilir. Satıcı işbu konuyla ilgili olan tüm soruları cevaplandıracağını kabul, beyan ve taahhüt eder. Bu bilgilerin sağlanmaması hallerinde, Satıcı ilgili Ürün/Hizmet satışının engellenebileceğini ve/veya Site üyeliğinin gerekli bilgiler sağlanana kadar ya da kalıcı olarak kapatılabileceğini kabul, beyan ve taahhüt eder.

4.17. Site üzerinde, satışa koyulan ilanların öne çıkarılması için kullanılan ve Doping adı verilen ek bir Hizmet bulunmaktadır. Bu hizmet yalnızca, satın alınan ilan için geçerli olup, ilanın yayından kaldırılması (Satıcı tarafından veya işbu Satış Sözleşmesinde bahsi geçen şekilde, ilanın satışa uygun olmayan şartlarının bulunması vb.), ilanın satılması veya satılmak üzere yayından kaldırılan bir ilanın satış şartlarına uygun olmaması sebebiyle, satışın iptal edilmesi durumlarında Satıcı'nın iptal/iade hakkı bulunmamaktadır.

4.18. Satıcı, işbu sözleşme uyarınca, şartlardan herhangi birini yerine getirmemesi ve/veya getirememesi sebebiyle oluşacak maddi ve manevi zarar ile birlikte, satış tutarının dört katını geçmeyecek şekilde cezai bedelin kendisi tarafından karşılanacağı kabul, beyan ve taahhüt eder.

* Tüm sorunlar: Hesapta yaşanacak kilitlenme, yasaklanma veyahut hesaba erişimin kaybolması durumları

** Tam sorumluluk hali: Oyun firmalarından bir hesabın geri alınması (kurtarılması) için hesabın açılış anında girilen bilgilerine (açılış tarihi, email, doğum tarihi gibi) sahip olmak gerekmektedir. Bu sebeple geri alınma durumunun (kurtarılma durumunun) hesabı oluşturan kişinin kontrolü dışında yapılmasının mümkün olmaması sebebiyle, hesabın geri alınması hallerinde Satıcı'nın taahhüt ettiği gibi mülkiyet hakkının kendisine ait olması durumu gözetilerek Satıcı sorumlu tutulmaktadır.

5. İptal ve İade Koşulları

5.1 Dijital Ürünler: Sipariş onaylandıktan ve Ürün teslim edildikten/gönderildikten sonra dijital ürünler için geri ödeme/para iadesi yapılmamaktadır. Site'de satışa sunulan ve/veya Site'nin satışa sunduğu dijital ürünleri alırken, indirirken veya kullanırken sorun yaşıyorsanız, yardım almak için öncelikle Store4Gamer ile iletişime geçmelidir.

İlgili mevzuata MESAFELİ SÖZLEŞMELER YÖNETMELİĞİ'nin 15. maddesinin (ğ) bendinden ulaşılabilir.

5.2 Oyun Hesapları Oyun Hesapları Sipariş onaylandıktan ve hesap bilgileri Kullanıcı ile paylaşıldıktan sonra, eğer Satıcı'nın belirttiği bilgilerde hata bulunmuyorsa ve/veya hesapta hesap değerini makul oranda* düşürücü bir sorun bulunmaması halinde, satın alınan oyun hesapları için geri ödeme/para iadesi yapılmamaktadır. Site'de satışa sunulan ve/veya Site'nin satışa sunduğu oyun hesaplarını alırken veya kullanırken sorun yaşıyorsanız, yardım almak için öncelikle Site ile iletişime geçmelidir.

*Makul oran: Store4Gamer olarak Site'ye eklenen birçok içeriği otomatik yazılımlar aracılığıyla eklemekteyiz. Eklenen bu içerikler belli periyotlarla güncellenmekte olup, oyun içi para birimleri gibi hızlı değişen içerikler olması sebebiyle, sizin satın alımınızda ilanda ifade edilen hesabın (Ürünün) içeriğinde farklılık oluşabilir. Ancak hesabın değerine bu durumun çok büyük bir etkisi olmaz. Her durumda bu değişimin hesap değerine ciddi bir oranda etki yapması halinde Alıcı'ların iptal taleplerine yardımcı olabilmekteyiz. Talebinizin değerlendirilmesinde karar merci, Site tarafından işleminize tahsis edilecek Satış Yöneticisi olacaktır.

6. Güvenli Alışveriş Sistemi

6.1. Alıcı ve Satıcı, sanal bir pazar yeri olarak yönetilen Site'de sağlanan Hizmet'lerden yararlanarak ve karşılıklı iradeleri ile, Ürün'ün fiyatı, nitelikleri ve teslim koşulları hakkında mutabakata varmaktadırlar.

6.2. Store4Gamer yönetimi, alım-satım sürecindeki Ürün bedelinin ödenmesi aşamasında, Alıcı ve Satıcı'ya, Güvenli Alışveriş Sistemi içinde Hizmet sunmaktadır. Güvenli Alışveriş Sistemi, Satıcı'yı, Ürün'ün teslimi karşılığında bedeli tahsil edememe riskine karşı; Alıcı'yı da bedelin ödenmesine karşılık, Ürün'ü teslim alamama veya istenilen nitelik ve şartlarda teslim alamama riskine karşı korumaktadır.

6.3. Güvenli Alışveriş Sistemi'nde, Alıcı ve Satıcı ticaretin tarafları olarak; Store4Gamer ise, ödemelerin yönetimi işleminde yer almaktadır. Store4Gamer, Güvenli Hesap adı altında, banka nezdinde bir hesap açtırmaktadır. Güvenli Hesap, Alıcı ve Satıcı'dan hukuken bağımsız, güvenilir üçüncü kişi olarak, Store4Gamer tarafından yönetilmektedir. Alım satım sürecine taraf olmayan Store4Gamer, Alıcı ve Satıcı'nın talimatları ve Site üzerinden gerçekleştirdikleri işlemler doğrultusunda, Mal ve/veya Hizmet bedellerinin Güvenli Hesap'a girişlerini ve Güvenli Hesap'tan çıkışlarını yönetmektedir. Güvenli Hesap'a yatırılan ve Güvenli Hesap'ta tutulan Mal ve/veya Hizmet bedellerinin mülkiyeti Store4Gamer'a ait değildir.

6.4. Alıcı'lar, Satıcı'lar ile mutabık kaldıkları Ürün bedellerini, Store4Gamer yönetimindeki Güvenli Hesap'a yatırmakta olup, Güvenli Hesap'ın girişlerini Alıcı'ların yatırdıkları Ürün bedelleri oluşturmaktadır. Güvenli Hesap'tan çıkışlar ise, Alıcı'ların talimatları doğrultusunda, Ürün bedeli olarak Satıcı hesaplarına aktarılan tutarlar; satışın, Alıcı ile Satıcı arasında mutabık kalınan koşullara uygun olarak gerçekleşmemesi halinde Alıcı'lara iade edilen Ürün bedelleri ve Alıcı'ların talimatlarına istinaden yapılan Satıcı'lara ödeme aşamasında, Banka komisyonları ile Store4Gamer Hizmet komisyonu olarak, Store4Gamer hesabına aktarılan tutarlardan oluşmaktadır. Talimatlara istinaden yönetilmekte olan Güvenli Hesap, banka nezdinde tutulmakta ve tüm kayıtlar internet ortamında tesis edilmektedir.

6.5. Kullanıcı'lar, Güvenli Alışveriş Sistemi'nden ve Hizmet'lerinden faydalanılarak alınıp satılan Ürün'lerin satışından veya satışa bağlı işlemlerinden kaynaklanacak her türlü vergi, resim, harç ve benzeri yükümlülüklerin hepsinden, doğrudan ve/veya dolaylı olarak sorumludurlar. Satış ve işlemlerden doğabilecek her türlü vergi, resim, harç ve benzeri yükümlülüklerden doğacak sorumlulukların hiçbirisi Store4Gamer'a ait değildir.

7. Sözleşmenin Feshi

İşbu sözleşme Satış'ın tamamlanması ile yürürlüğe girdiği andan itibaren süresiz olarak yürürlükte kalacaktır.

8. İhtilafların Halli

İşbu sözleşmeye ilişkin ihtilaflarda İstanbul Mahkemeleri ve İcra Daireleri yetkilidir.

9. Yürürlük

Kullanıcı'nın, herhangi bir sipariş için ödeme yaptığı ve/veya satışını yapmak üzere Ürün ilanı eklediği andan itibaren işbu Satış Sözleşmesi'ni tüm maddeleriyle birlikte okuduğu, anladığı ve kabul ettiği kabul edilir.

1. Definitions/Parties

Definitions: Unless stated otherwise, the terms used on this page are the same as the terms in the User Agreement.

2. Subject and Scope of the Agreement

2.1. The subject of this Sales Agreement is the determination of the Services offered on the Site, the terms of benefiting from these Services and the rights and obligations of the parties.

2.2. The scope of this Sales Agreement is all statements such as warnings, texts and explanations made by Store4Gamer regarding usage, membership and Services in the Site.

2.3. By accepting the terms of this Sales Agreement, you also agree that you will comply with all kinds of statements made by Store4Gamer regarding the use, membership and Services on the Site and to comply with these statements.

3. Buyer Rights and Obligations

3.1. The buyer can cancel or give up a product or products for which he has paid for the purchase, only within the cancellation conditions offered by the Site.

3.2. The Buyer, using the Secure Shopping Service (ARTICLE 6), the prices of the Products that he has purchased or is entitled to purchase, to the Secure Account managed by Store4Gamer, the purchase-sale transaction between the Buyer and the Seller, the delivery of the Product by the Seller and the Buyer. It will ensure that the payment is made to be blocked until its acceptance by the Company.

3.3. The buyer accepts, declares and undertakes that he will give approval to complete the transaction within 24 hours upon receipt of the product.

3.4. If the Buyer refuses to sell or deliver the Product at any stage of the buying and selling process on the Site and for whatever reason, Store4Gamer will have no responsibility or liability for this situation; It accepts, declares and undertakes that it cannot demand from Store4Gamer the supply of the Product or its equivalent, under any circumstances, or any compensation based on it.

3.5. The Buyer accepts, declares and undertakes that the Site cannot be held responsible for any problems that may occur after the sale of any Product, and that only the Seller can be held responsible for any problems that may arise.

4. Seller Rights and Obligations

4.1 The Seller declares that the property of the Product offered for sale on the Site belongs to him and/or he is authorized to transfer the ownership and that there are no legal or other obstacles to the sale of the Product by him, that the products do not violate personality, copyright and other intellectual property rights. accepts, declares and undertakes.

4.2. The Seller accepts that all legal responsibility of the Products offered for sale on the Site belongs to him, and that Store4Gamer is not in any direct and/or indirect relationship with him under any title, regarding the supply and sale of the Product.

4.3. The Seller is responsible for the accuracy of the contents of the Product offered for sale on the Site. In addition, it accepts, declares and undertakes that it has access to registered 3rd party connections, telephone and e-mail address necessary and / or possible for the transfer of the Product to the Buyer.

4.4. The Seller accepts, declares and undertakes that the Product offered for sale does not have any restrictions, prohibitions, defects or any unspecified depreciation of value.

4.5. The Seller accepts, declares and undertakes that he/she bears all responsibility in case of security-related lockdown (restriction) and/or restriction, prohibition that may occur due to an action taken and/or occurred before the sale, after the sale, due to the take-back of the product he has sold.

4.6. After the sale, the seller can contact the relevant game company for the product he has sold, and the relevant account (Product) is stolen/access is lost, etc. He accepts, declares and undertakes that he will not save the account for any reason, and that if this situation is realized by himself or someone else, he will cover all material and moral damage to the Site and the Buyer and / or an investigation may be opened against him for the crime of qualified fraud.

4. Seller Rights and Obligations

4.1 The Seller declares that the property of the Product offered for sale on the Site belongs to him and/or he is authorized to transfer the ownership and that there are no legal or other obstacles to the sale of the Product by him, that the products do not violate personality, copyright and other intellectual property rights. accepts, declares and undertakes.

4.7. If the Seller is found to be unfair and/or guilty by Store4Gamer after the sale, in relation to the product he has sold, if he does not accept the relevant crime and/or if the mutual agreement cannot be reached within the time determined by Store4Gamer, in order to resolve the problem, the It accepts, declares and undertakes that action will be taken in accordance with the Dispute Settlement article.

4.8. In any action against the Seller, the aforementioned Buyer and/or Store4Gamer, the Store4Gamer membership will be suspended and/or closed; If an order is in question, it accepts, declares and undertakes that the order can be canceled against the Seller without information and/or declaration.

4.9. The Seller has the right and authority to offer and sell a product to be offered for sale on the Site at a fixed price (price) that it has announced beforehand. The Seller accepts, declares and undertakes that if the Buyer sends the Product price to the Secure Account, the Buyer is entitled to receive the Product with priority.

4.10. The Seller may request an action to Store4Gamer in order for the Buyer to receive the Product and transfer the Product price in the Secure Account to the Seller's account, or that the Product sent to him by the Seller does not exceed the features, content specified in the advertisement, or any prohibition, He/she accepts, declares and undertakes that he/she may return the Product to the Seller and request a transaction to Store4Gamer for the product price to be returned to him due to the restriction.

4.11. During the delivery of the Order to the Buyer, if the conditions expressly stated above and accepted, declared and committed by the Seller are not met, the relevant order will be canceled against the Seller without the need for an additional notification. In the event that this situation occurs, it is the Seller's responsibility to change the password for the security of the account and to ensure account security.

4.12. The Seller accepts, declares and undertakes that it has no connection with the account (Product) to which it sells and that it conveys, transfers, transfers all its rights to the Buyer.

4.13.
